Legal requirements for property boundaries: What you should know

Do you already have an idea of what you need and how much your new fence should cost? Then be sure to also find out about the locally applicable building regulations. Both state and municipal regulations may exist that relate to the permissible height, design, and materials of your fence. Anyone wanting to redefine their property boundaries should not make any decisions without first checking the legal framework. A look at the respective building code or the neighbor law of your state is the first step. In Bavaria, for example, the Bavarian Building Code (Art. 57) stipulates that fences within a built-up area may be erected without a permit up to a height of two meters – provided no other municipal regulations prohibit it. In the so-called "outer area" (i.e., outside of built-up areas, for example, on the outskirts of a town), a permit is required. However, there is no general obligation to erect a fence in Bavaria.

The situation is quite different in Berlin. The Berlin Neighbor Law (§21-26) stipulates that every property owner is generally obligated to demarcate their property with a fence customary for the locality. "Customary for the locality" means that the fence should be in keeping with its immediate surroundings in terms of height, shape, and material. The streetscape or the character of the respective residential area is decisive in this regard. In Berlin, a 1.25-meter-high chain-link fence is generally considered customary. This type is common in many residential areas and therefore usually easy to implement. However, higher-quality or more modern fences—for example, made of metal or with privacy features—are not categorically prohibited. As long as they blend in visually with the streetscape.

In addition to state laws, municipal bylaws or zoning plans may contain further regulations – for example, regarding maximum height, colour, or permitted fence type. These regulations can usually be found on your municipality's website. If in doubt, it's best to ask directly at the local building authority or town hall.
